Unless you signed a security agreement, no other lenders can go after your automobile. A credit card company cannot repossess your car in order to collect the credit card debt you owe.&lt;/p&gt;&lt;p&gt;Typically, when you sign a car loan, you also sign a security agreement. Valid agreements describe the type of car, or collateral, as well as its value. It also must belong to you. For example, if you buy a car for your son, he has all rights to the collateral and must sign the security agreement. If he doesn’t sign the agreement, there is no valid security interest and the car isn’t able to be repossessed by the creditor.&lt;/p&gt;&lt;p&gt;Check the agreement to see that there is nothing missing and no glaring mistakes jump out at you. If there is a mistake and the security agreement is invalid, the creditor cannot repossess the car, even if you defaulted on the loan. If you can’t find your copy of the agreement, ask your creditor.&lt;/p&gt;&lt;p&gt;After you default on your loan&lt;/p&gt;&lt;p&gt;A lender cannot repossess your car until you default on the loan. How do you default on a loan? By failing to either pay the monthly premium or purchase insurance are the most common ways to default. If you lose or destroy the car, sell or move it without permission – these are also ways to default on a loan.&lt;/p&gt;&lt;p&gt;Keep in mind that many states will not allow a creditor to declare that you defaulted without giving you reasonable notice or accepting late payments, especially if they’ve accepted late payments in the past.&lt;/p&gt;&lt;p&gt;What does it mean to accelerate?&lt;/p&gt;&lt;p&gt;Some security agreements have an "acceleration clause" and it’s important to determine if yours does once you’ve started defaulting your loans.&lt;/p&gt;&lt;p&gt;An acceleration clause means you can’t fix the default only by paying the past due amount. Your lender can demand the entire balance of the loan or threaten repossession. State law determines whether or not your creditor has to warn you ahead of time that your loan is about to accelerate. Sometimes the lender has a legal obligation to tell you that you have a "right to cure" the default.&lt;/p&gt;&lt;p&gt;During the repossession&lt;/p&gt;&lt;p&gt;The lender cannot commit certain acts during the repossession. They cannot:&lt;/p&gt;&lt;p&gt;* Touch or push you&lt;/p&gt;&lt;p&gt;* Damage your property&lt;/p&gt;&lt;p&gt;* Trick or lie to you&lt;/p&gt;&lt;p&gt;* Threaten you if you feel immediate fear (for example, a creditor's threat to seize your car at some future time does not put you in immediate fear, so there is no breach of peace)&lt;/p&gt;&lt;p&gt;* Ignore your objections --if you, your relative or your friend objects to the repossession but the creditor still repossesses the car, he breaches the peace. You should object at the time the creditor takes the car. If you object after the creditor took the car, it is too late. If a sheriff or other government official is present, don't resist his seizure of the car, but verify the official's authenticity.&lt;/p&gt;&lt;p&gt;* Enter a closed garage. Even without physically breaking in, a creditor breaches the peace when he enters a closed garage. Generally, there is no breach of peace if the creditor takes the vehicle from the public street, a parking lot, a private driveway, an open garage or a carport. A creditor's trespass can be a breach if there is a potential for immediate violence.&lt;/p&gt;&lt;p&gt;* Bring the police. If you are financing a new vehicle, most insurance companies require you to carry full coverage. If you have an older, used vehicle, the amount of coverage you choose is up to you. Although, each state does have minimum auto insurance requirements as you will soon read. However, before you decide how much of each auto insurance option you need, you first need to understand the basics of each type of coverage.&lt;/p&gt;&lt;p&gt;Liability&lt;/p&gt;&lt;p&gt;Liability insurance is the most basic form of auto insurance. Liability insurance protects drivers, passengers, and the other vehicle occupants with whom policyholders share the road from financial disaster in the event of an accident. It is required in most every state and often appears in a numerical sequence such as 20/40/10. The first number refers to the financial limit, in thousands, for an individual driver injured in an accident. The second number represents the maximum amount of coverage for all parties injured in an accident. Finally, the last number represents the total amount of property damage protection.&lt;/p&gt;&lt;p&gt;Comprehensive&lt;/p&gt;&lt;p&gt;Comprehensive insurance protects drivers from a variety of instances such as theft, vandalism, and property damage caused by acts of weather. Just like liability insurance, comprehensive protection is also subject to financial limits.&lt;/p&gt;&lt;p&gt;Collision&lt;/p&gt;&lt;p&gt;When you are involved in a collision, this form of insurance provides you with financial protection. This form of insurance also has financial limits. &lt;/p&gt;&lt;p&gt;Uninsured/Underinsured motorists (UM)&lt;/p&gt;&lt;p&gt;Unfortunately, an estimated 50% of the drivers on the road do not carry sufficient auto insurance. If one of these drivers hits you, it is often very difficult to recuperate your losses. However, with enough uninsured/underinsured insurance, you are safe.&lt;/p&gt;&lt;p&gt; GAP&lt;/p&gt;&lt;p&gt;As soon as you purchase a vehicle and drive it off the lot, it loses value. If you destroy your vehicle as soon as you leave the dealership, your insurance would only provide you with current value of the vehicle, not the amount you paid for it. This is why most insurance companies require those who finance a new vehicle to purchase affordable GAP insurance. This form of insurance provides drivers with the difference between the current vehicle value, and the amount they paid. &lt;/p&gt;&lt;p&gt;Minimum requirements&lt;/p&gt;&lt;p&gt;As previously stated, each state has varying minimum auto insurance requirements. A vast majority simply require drivers to carry liability limits such as 20/40/20. However, some states require additional coverage such as uninsured/underinsured protection. Two states, New Hampshire and Wisconsin do not require drivers to carry a minimum amount of insurance but rather that they prove they are financially able to pay for an accident.&lt;/p&gt;&lt;p&gt;No Fault&lt;/p&gt;&lt;p&gt;There are twelve states in America, which are no fault states. These states include FL, HI, KS, KY, MA, MI, MN, NJ, NY, ND, PA, and UT. If you live in one of these sates, you will have to carry a minimum amount of auto insurance, but will be subject to a different claims process. No fault states essentially require drivers to pay for their own damages regardless of fault. For instance, if someone hit you, your insurance pays for your damages. The no fault method does speed up the claims process as it avoids legal proceedings. However, in some instances, drivers may sue responsible parties depending on the state and the amount of damage.&lt;/p&gt;&lt;p&gt;Deductibles&lt;/p&gt;&lt;p&gt;A deductible is the amount a driver must pay before the insurance company pays toward your financial limits. Typically, deductibles range from $500-$1000. It wasn’t your fault, so why the heck did your insurance premiums go up? Chances are you’re insurance company is penalizing you for an accident or traffic violation that may have happened months or years ago.&lt;br /&gt;If you have a spotless driving record, it is highly unlikely that your premiums will increase after an accident that wasn’t your fault. However, if you have just one related traffic violation, or fender bender prior to this no-fault accident, then you will probably see an increase in your rates. The length of time varies from company to company. So, if you were an accident that was your fault two or three years before this no-fault accident, the insurance company might consider you “accident-prone” and increase your rates. The length of time between accidents varies from company to company.&lt;br /&gt;&lt;br /&gt;Keep in mind that “fault” is determined by the authorities. You may feel that you were not at fault in an accident, or that the other driver was a maniac. But, the authorities make that decision, and the party that is ticketed during the incident is considered to be at fault.&lt;br /&gt;Insurance companies base their premiums on risk-factor. So, even if someone rear-ends you at a stoplight when you were minding your own business, if you’ve had a speeding ticket or other violation prior to this accident, you might be deemed an at-risk driver. Each insurance company has different policies and standards, but they look at your overall propensity towards accidents.&lt;br /&gt;Some companies will forgive past accidents after a certain period of time has passed. This can be as little as two years, or as much as five years, but again, it varies from company to company. If you go without a speeding ticket or other traffic violation for many years, chances are that you premium will decrease.&lt;br /&gt;&lt;br /&gt;The number of accidents you are in directly affects your premium. You could be in six no-fault accidents, and your company would still raise your rates. They feel that even though the authorities determined these accidents not to be your fault, that you must have something wrong with your driving to be having so many crashes. Are you cursed, or just accident-prone? Insurance fraud also plays a small factor in this equation. Many people “stage” accidents to reap settlements from insurance companies. A high number of no-fault accidents might raise a red-flag with an insurance company.&lt;br /&gt;&lt;br /&gt;If you have any concerns about an increase in premiums, contact your insurance agent to discuss the problem.
